Jakarta Company Registration: Restaurant Licenses

The restaurant business is one of the sectors that have the potential to grow in Indonesia, especially in big cities such as Jakarta and Bali.

The McKinsey Global Institute stated that 90 million new Indonesians are likely to join the consuming class, making it as big as about 135 million by 2030. This will significantly influence the increase in Indonesians’ purchasing power as Indonesians transition to the consuming class.  The middle community has started to adopt a lifestyle where in addition to basic needs, social branding also plays an important role. Therefore, the value of consumption in the retail sector, especially the restaurant, will also experience a significant increase.

Which regulation should Restaurant Business refer to?

Formerly, the food and drink service business was referred to as a tourism business. The owner may refer the regulations to the Ministerial Regulation of the Ministry of Culture and Tourism No. PM. 87 /HK.501/MKP/2010.

However, in response to the OSS Regulation, the Ministry of Culture and Tourism issued an updated regulation under the Minister of Culture and Tourism Regulation No. 10 of 2018. The essence is concerning Integrated Business Licensing E-Service in the Tourism Sector (“Tourism OSS Regulation”).

Who is allowed to obtain a Restaurant License?

Essentially, anyone with a legal entity established under Indonesian Law can obtain a Restaurant License.

The country welcomes either local or foreign investors entering the restaurant business. Opening a restaurant is very much similar to doing another Company Registration in Indonesia. Founders must set up the type of investment they would like to select according to the investors’ statuses. Direct investment in a Limited Liability Company (PT) will be perfect for local investors.
